Terms of Service

These Terms of Service, together with any policies, notices, or additional terms referenced in these Terms, govern your access to and use of WhaleTracks, available at whaletracks.com, including any related websites, applications, tools, features, content, subscriptions, analytics, data, and services provided by WhaleTracks LLC.

These Terms are a legally binding agreement between you and WhaleTracks LLC, a California limited liability company ("WhaleTracks," "Company," "we," "us," or "our"). By accessing or using WhaleTracks, creating an account, purchasing a subscription, viewing our analytics, or clicking a button or checkbox indicating acceptance, you agree to these Terms. If you do not agree to these Terms, do not access or use WhaleTracks.

1. Important Notice: WhaleTracks Is an Analytics Tool Only

WhaleTracks is a real-time prediction-market analytics and information tool. WhaleTracks is designed to help users follow publicly visible trading activity on third-party prediction-market exchanges — such as wallet track records and large-trade flow — compare prices for related event contracts across exchanges, and view rankings, scores, and calculations based on our models and public data.

WhaleTracks is not an exchange, broker, dealer, investment adviser, commodity trading advisor, financial institution, payment custodian, sportsbook, casino, gambling operator, or wagering platform.

WhaleTracks does not:

  • Accept, facilitate, route, place, or execute trades, orders, or positions on any exchange or platform;
  • Hold user funds for trading, settlement, or payouts;
  • Pay winnings, returns, or settlement proceeds;
  • Submit trades or orders to third-party platforms on your behalf;
  • Guarantee prices, spreads, liquidity, resolutions, results, profits, or positive returns;
  • Provide personalized investment, trading, financial, legal, or tax advice.

Links labeled "Copy," "Buy," or similar open the applicable third-party exchange. Any shares you buy are bought by you, on that exchange, under that exchange's terms. All decisions you make based on information available through WhaleTracks are made solely by you. You are solely responsible for determining whether, where, when, and how to use any information shown by WhaleTracks.

2. Eligibility

You may use WhaleTracks only if you:

  • Are at least 18 years old, or the age of majority and legal eligibility required in your jurisdiction, whichever is higher;
  • Are legally permitted to use market-analytics tools and informational services in your jurisdiction;
  • Are not prohibited from using WhaleTracks under applicable law;
  • Can form a legally binding contract with WhaleTracks; and
  • Agree to comply with these Terms.

If you are under the required age or are not legally permitted to use WhaleTracks where you are located, you may not access or use WhaleTracks. We may restrict, suspend, or terminate access to WhaleTracks in any jurisdiction or for any user where we believe use may be unlawful, restricted, or create legal, regulatory, operational, or reputational risk.

3. Your Responsibility for Legal Compliance

Laws relating to prediction markets, event contracts, derivatives, and related trading activity vary by jurisdiction and may change over time. You are solely responsible for understanding and complying with all laws, rules, regulations, platform terms, and eligibility requirements that apply to you, including those related to:

  • Prediction markets and event contracts;
  • Trading and derivatives regulation;
  • Age restrictions;
  • Location and residency restrictions on third-party exchanges;
  • Tax obligations;
  • Third-party platform rules, including the terms of service of Polymarket, Kalshi, and any other exchange you use.

WhaleTracks does not guarantee that WhaleTracks, any third-party exchange, any market, any contract, or any related activity is lawful or available in your jurisdiction.

4. No Personalized Advice

WhaleTracks provides general analytics, data, calculations, rankings, scores, comparisons, simulations, tools, and informational content. WhaleTracks does not provide personalized recommendations or advice tailored to your financial situation, risk tolerance, trading history, location, platform eligibility, personal circumstances, or legal status.

Even if WhaleTracks displays a market, price, score, ranking, expected-value estimate, divergence, arbitrage opportunity, sizing calculation, simulated result, or other signal, that information is not a recommendation that you personally enter a trade, make a financial decision, or take any action. You should not rely on WhaleTracks as your sole basis for any decision. You are responsible for evaluating all information independently.

5. Responsible Use

WhaleTracks is an analytics and information tool, but the information relates to markets where real money can be lost. You should use WhaleTracks responsibly. You should not use WhaleTracks or any third-party trading platform if doing so may cause financial, emotional, legal, or personal harm, and you should never risk money you cannot afford to lose.

If your trading or use of event-contract markets is causing you harm, seek help. In the United States, you may call 1-800-GAMBLER or visit ncpgambling.org for free, confidential resources. We may suspend or terminate your access if we believe your use of the Service creates safety, legal, or compliance concerns.

6. Description of the Service

WhaleTracks may provide features including, but not limited to:

  • Wallet leaderboards, track records, and sharpness scoring;
  • Aggregate performance views such as the Master Wallet;
  • Live feeds of publicly visible trading activity;
  • Anonymous exchange-flow analytics;
  • Market movers, new-market listings, and resolution calendars;
  • Cross-exchange price comparison, divergence, and arbitrage analytics;
  • Pricing-consistency scanners and sizing calculators;
  • Historical replays and hypothetical simulations;
  • Watchlists, portfolio views, alerts, and saved preferences;
  • Educational guides and articles;
  • Subscription-based access to the analytics tools.

Access to WhaleTracks is membership-based. Our home page, pricing page, legal pages, educational guides, strategy articles, methodology, and comparison pages are available without a subscription. The analytics tools — including wallet leaderboards, the Master Wallet, live trade feeds, exchange-flow analytics, divergence and arbitrage analytics, scanners, calculators, watchlists, portfolio views, and alerts — require an active paid subscription. We do not offer a free trial. We may change which features are available without a subscription at any time.

We may add, modify, limit, suspend, discontinue, or remove any feature at any time, with or without notice.

7. Third-Party Platforms and Data Sources

WhaleTracks may display, reference, compare, aggregate, process, or analyze information related to third-party exchanges, markets, event contracts, wallets, prices, or related content. Third-party platforms and sources may include, but are not limited to, Polymarket, Kalshi, Manifold, and other market-data sources.

WhaleTracks is not affiliated with, endorsed by, sponsored by, or officially connected to any third-party exchange, platform, data provider, or brand unless expressly stated by WhaleTracks in writing. Third-party names, trademarks, logos, and brands belong to their respective owners and are used for identification and informational purposes only.

We do not control third-party platforms or data sources. Third-party prices, order books, liquidity, availability, market rules, resolution criteria, and market conditions may change quickly and may be inaccurate, delayed, incomplete, unavailable, or different from what appears on WhaleTracks. You are solely responsible for confirming all information directly with the applicable third-party platform before taking any action.

8. Accuracy, Availability, and No Guarantees

WhaleTracks attempts to provide useful analytics and information, but we do not guarantee that any data, calculation, score, price comparison, divergence, simulation, projection, ranking, result, or other content is accurate, complete, current, profitable, or available. You understand and agree that:

  • Prices and order books may change rapidly;
  • Exchanges may suspend, delist, or re-price markets;
  • Aggregated third-party data may contain errors or delays;
  • Calculations may be based on assumptions or incomplete data;
  • Positive expected value does not guarantee profit;
  • Simulated or hypothetical results, including tail simulations, are hypothetical, retroactive, and do not reflect real trading costs, slippage, or availability;
  • Past performance does not guarantee future results;
  • Related markets may resolve differently across exchanges under their respective rules;
  • Any trade or position may result in financial loss.

WhaleTracks makes no guarantee that you will make money, avoid losses, identify profitable opportunities, or achieve any specific outcome.

9. Accounts and Authentication

To access certain features, you may need to create an account or authenticate using Google sign-in through Supabase. You agree to provide accurate and complete information and to keep your account information current. You are responsible for maintaining the confidentiality and security of your account, login credentials, devices, and sessions.

You are responsible for all activity that occurs under your account, whether or not authorized by you, except to the extent caused by our gross negligence or willful misconduct. You must notify us promptly at whaletracks123@gmail.com if you believe your account has been compromised.

We may suspend, restrict, or terminate your account if we believe you have violated these Terms, created risk for WhaleTracks or other users, used WhaleTracks unlawfully, attempted to abuse the Service, or engaged in conduct we deem harmful.

10. Subscriptions, Discounts, Billing, and Auto-Renewal

WhaleTracks offers paid subscription plans and does not offer a free trial. As of the date of these Terms, plans are billed weekly or monthly, and every plan provides the same full access. Current or future plans may include weekly, monthly, annual, promotional, discounted, or other subscription options. Prices, features, billing periods, renewal terms, discounts, and promotional-offer availability may vary and may change over time. Any specific subscription terms presented to you at checkout are incorporated into these Terms and control if they conflict with this section.

10.1 Automatic Renewal

Unless otherwise stated at checkout, subscriptions automatically renew at the end of each billing period until canceled. By accepting a promotional offer or purchasing a subscription, you authorize WhaleTracks and its payment processor, Stripe, to charge your selected payment method for recurring subscription fees, applicable taxes, and other charges disclosed to you at checkout.

10.2 Discounts and Promotional Offers

WhaleTracks does not offer free trials. We may offer discounts, promotional or introductory pricing, coupons, or other special offers from time to time. Eligibility, duration, pricing, features, renewal terms, and other conditions will be disclosed at checkout or in the applicable offer. If a discount or introductory price is offered, it may apply only for the period disclosed at checkout — for example, a reduced price for a first billing period — after which your subscription automatically renews at the then-current standard price unless you cancel before renewal. Offers may be limited to one per person or account, and we may limit eligibility for offers and may modify or discontinue them at any time, subject to applicable law.

10.3 Payment Processing

Payments are processed by Stripe or another payment processor we may use in the future. WhaleTracks does not store full credit card numbers. Your payment information is handled by the payment processor and may be subject to that processor's own terms and privacy policy.

10.4 Failed Payments

If your payment method fails, we may attempt to charge it again, request updated payment information, suspend your subscription, limit access, or terminate your subscription. You remain responsible for unpaid amounts to the extent permitted by law.

10.5 Cancellation

You may cancel your subscription through the account, billing, customer portal, checkout management flow, or other cancellation method made available by WhaleTracks or Stripe. Cancellation stops future renewal charges but does not necessarily provide a refund for the current billing period unless required by law or expressly stated by WhaleTracks. After cancellation, you may continue to have access until the end of the paid billing period unless otherwise stated.

10.6 Refunds

Except where required by law, payments are non-refundable. We may consider refund requests at our discretion, but granting a refund in one case does not require us to grant refunds in the future.

10.7 Changes to Pricing or Subscription Terms

We may change subscription prices, features, which features require a subscription, discount terms, promotional terms, renewal terms, or billing terms. If required by law, we will provide notice and obtain any required consent before changes take effect.

11. Acceptable Use

You agree not to:

  • Use WhaleTracks for any unlawful purpose;
  • Use WhaleTracks if you are underage or prohibited from using it;
  • Violate any applicable law, regulation, or third-party platform rule;
  • Copy, scrape, crawl, harvest, extract, or bulk download data from WhaleTracks without permission;
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from WhaleTracks;
  • Interfere with, disrupt, overload, or compromise our systems;
  • Circumvent paywalls, authentication, rate limits, usage limits, access controls, or security features;
  • Share, resell, sublicense, publish, or redistribute paid WhaleTracks data or analytics;
  • Use bots, scripts, automated tools, or unauthorized APIs to access WhaleTracks;
  • Upload or transmit viruses, malware, or harmful code;
  • Attempt to gain unauthorized access to accounts, systems, or data;
  • Misrepresent your identity or affiliation;
  • Use WhaleTracks to harass, abuse, threaten, or harm others;
  • Use WhaleTracks in a way that creates legal, regulatory, operational, or reputational risk for us.

We may monitor usage for security, abuse prevention, and enforcement, and may suspend or terminate accounts that violate these Terms.

12. User Settings and User Content

WhaleTracks may allow you to save preferences, settings, filters, watchlists, notes, alert rules, portfolio addresses, or similar configurations. You are responsible for the information and preferences you submit, save, or configure. You grant WhaleTracks a limited right to process, store, display, and use this information as necessary to provide and improve the Service. You represent that you have the rights necessary to submit any information you provide and that your information does not violate law or the rights of others.

13. Intellectual Property

WhaleTracks, including its software, design, interface, features, models, calculations, scores, organization, branding, logos, text, graphics, workflows, analytics presentation, and other content, is owned by WhaleTracks or its licensors and is protected by intellectual property and other laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use WhaleTracks for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, sell, lease, sublicense, publicly display, publicly perform, reverse engineer, or create derivative works from WhaleTracks except as expressly permitted by us in writing.

14. Feedback

If you submit suggestions, ideas, bug reports, feature requests, comments, or other feedback, you grant WhaleTracks a worldwide, perpetual, irrevocable, royalty-free right to use, copy, modify, distribute, display, and otherwise exploit that feedback for any purpose without compensation or obligation to you.

15. Privacy

Your use of WhaleTracks is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information. By using WhaleTracks, you acknowledge that you have reviewed our Privacy Policy.

16. Service Availability and Changes

WhaleTracks may be unavailable from time to time due to maintenance, updates, outages, data-source issues, hosting issues, third-party failures, security incidents, technical problems, or other reasons. We do not guarantee uninterrupted, secure, or error-free availability. We may modify, suspend, or discontinue all or part of WhaleTracks at any time, with or without notice.

17. Beta, Experimental, and Informational Features

Some WhaleTracks features may be experimental, incomplete, or provided in beta form, including scoring models, cross-exchange matching, flow analytics, simulations, and other features. Beta or experimental features may be changed, removed, inaccurate, unavailable, or unreliable. You use such features at your own risk.

18. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHALETRACKS IS PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHALETRACKS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, SECURITY, AND QUIET ENJOYMENT.

WITHOUT LIMITING THE FOREGOING, WHALETRACKS DOES NOT WARRANT THAT:

  • THE SERVICE WILL BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, SECURE, OR ERROR-FREE;
  • ANY DATA, PRICE, SCORE, EXPECTED-VALUE CALCULATION, SIMULATION, PROJECTION, OR ANALYTIC WILL BE CORRECT OR PROFITABLE;
  • THIRD-PARTY DATA WILL BE AVAILABLE, ACCURATE, OR CURRENT;
  • YOU WILL MAKE MONEY, AVOID LOSSES, OR ACHIEVE ANY PARTICULAR RESULT;
  • ANY THIRD-PARTY EXCHANGE, MARKET, OR CONTRACT WILL REMAIN AVAILABLE;
  • WHALETRACKS WILL MEET YOUR NEEDS OR EXPECTATIONS.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHALETRACKS LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, LOSS OF GOODWILL, PERSONAL LOSSES, TRADING LOSSES, OR FINANCIAL LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHALETRACKS' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO WHALETRACKS IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

20. Assumption of Risk

You understand and agree that using WhaleTracks involves risks, including risks related to inaccurate data, delayed data, changing prices, incorrect calculations, model error, third-party platform restrictions, legal restrictions, and financial loss. You knowingly and voluntarily assume all risks associated with your use of WhaleTracks and any decisions you make based on information available through WhaleTracks.

21. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless WhaleTracks LLC and its owners, members, managers, officers, employees, contractors, agents, service providers, licensors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: your use or misuse of WhaleTracks; your violation of these Terms; your violation of applicable law or third-party rights; your use of third-party exchanges or related services; your trades, positions, financial decisions, or related activity; your violation of third-party platform rules; information or content you submit to WhaleTracks; or your fraud, misconduct, negligence, or willful misconduct. We reserve the right to control the defense of any matter subject to indemnification, and you agree to cooperate with us.

22. Suspension and Termination

We may suspend, restrict, or terminate your access to WhaleTracks at any time if we believe: you violated these Terms; you used WhaleTracks unlawfully or abusively; your account creates risk for WhaleTracks, other users, or third parties; you attempted to circumvent payment, access controls, rate limits, or security features; your use may violate law or create regulatory risk; or continued access would be harmful, unsafe, or inappropriate.

You may stop using WhaleTracks at any time. Subscription cancellation is handled separately under the subscription and billing terms above. Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and payment obligations.

23. Communications

You agree that we may send you service-related communications, including account, authentication, security, billing, subscription, legal, and transactional notices. Transactional emails may be sent through Supabase Auth, Stripe, or other service providers. If we later send marketing emails, you will be able to opt out as required by applicable law; even if you opt out of marketing communications, we may still send transactional or service-related messages.

24. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice by posting the updated Terms, updating the "Last Updated" date, sending an email, displaying an in-product notice, or using another reasonable method. Your continued use of WhaleTracks after updated Terms become effective means you accept the updated Terms. If you do not agree to updated Terms, you must stop using WhaleTracks and cancel any subscription.

25. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law preempts California law.

26. Dispute Resolution; Informal Resolution

Before filing any formal claim, you agree to first contact WhaleTracks at whaletracks123@gmail.com and provide a brief written description of the dispute, your contact information, and the relief you seek. You and WhaleTracks agree to attempt to resolve the dispute informally for at least 30 days before either party initiates a formal proceeding, unless doing so would be prohibited by law or would cause irreparable harm.

27. Venue

Subject to any arbitration agreement or small-claims rights that may be added in the future, you and WhaleTracks agree that any legal action arising out of or relating to these Terms or WhaleTracks will be brought exclusively in the state or federal courts located in California, unless applicable law requires otherwise. You and WhaleTracks consent to personal jurisdiction and venue in those courts.

28. Injunctive Relief

You agree that a breach of sections relating to intellectual property, unauthorized access, scraping, redistribution, reverse engineering, or misuse of WhaleTracks may cause irreparable harm for which monetary damages would be inadequate. WhaleTracks may seek injunctive or equitable relief without posting a bond, to the extent permitted by law.

29. Force Majeure

WhaleTracks will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, internet or hosting failures, cyberattacks, labor disputes, war, terrorism, civil unrest, government action, regulatory changes, third-party platform changes, data-source outages, payment processor failures, or other events beyond our control.

30. Assignment

You may not assign or transfer these Terms or your rights or obligations under these Terms without our prior written consent. WhaleTracks may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or by operation of law.

31. Severability

If any provision of these Terms is found unenforceable, invalid, or unlawful, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

32. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision or any other provision in the future.

33. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented to you, constitute the entire agreement between you and WhaleTracks regarding your use of the Service and supersede any prior or contemporaneous agreements on that subject.
